1. The information contained on this menu, website, signage, and any “related materials” is provided for general informational purposes only. By dining with or using the services of Hercules Churrasqueria, “the Restaurant”, you agree to the terms of this disclaimer.
2. Menu and Pricing Disclaimer  
   Menu items, prices, specials, descriptions, availability, and portion sizes are subject to change without prior notice. While we strive for accuracy, typographical errors may occur. We reserve the right to refuse an order or cancel a reservation in such instances.
3. Allergens and Dietary Needs  
   Our kitchen handles eggs, milk, fish, shellfish, tree nuts, peanuts, wheat, soy, and other allergens. We cannot guarantee that any menu item is free from particular allergens due to cross-contact in a shared kitchen. Guests with food allergies, intolerances, or specific dietary needs should inform their server prior to ordering. The Restaurant is not liable for adverse reactions to foods consumed or items one may come into contact with while dining here.
4. Consumption of Undercooked Foods  
   Certain menu items may be served raw or undercooked. Consuming raw or undercooked meats, poultry, seafood, shellfish, or eggs may increase the risk of foodborne illness. Guests who are pregnant, elderly, very young, or who have certain medical conditions should consult a physician before consuming such items. By ordering these items, you assume the associated risks.
5. Alcohol Service and Intoxication Policy  
   Alcoholic beverages are served in accordance with New York State and Suffolk County laws. We reserve the right to refuse service to any person who appears intoxicated or is unable to provide valid identification proving they are of legal drinking age. The Restaurant and its staff are not responsible for consequences arising from patrons’ decisions to drive or engage in other activities while intoxicated.
6. Service Charges, Gratuities, and Fees  
   Applicable service charges, gratuities, delivery fees, or corkage charges may be added to the bill. Any mandatory service charge is distributed in accordance with our policies and applicable law. Suggested gratuities are solely that—suggestions—and remain at the discretion of the guest unless otherwise stated as mandatory.
7. Reservations, Cancellations, and No-Shows  
   Reservation, cancellation, and no-show policies may vary. Fees or deposits may apply for large parties, private events, or late cancellations. Please review the specific terms associated with your reservation.
8. Photography and Recording  
   The Restaurant may take photos or videos for marketing and security purposes. By entering the premises, guests consent to being photographed or recorded and grant the Restaurant a perpetual, royalty-free license to use such images and recordings for promotional purposes, unless otherwise prohibited by law. Guests wishing to take photographs or conduct professional shoots should obtain prior consent.
9. Property, Personal Items, and Damages  
   The Restaurant is not responsible for lost, stolen, or damaged personal items. Guests are responsible for damage caused by them or their guests to the Restaurant’s property. We reserve the right to seek compensation for repair or replacement costs.
10. Health and Safety Compliance  
   We comply with all applicable federal, state, and local health, safety, and licensing regulations, including those of Suffolk County and New York State. Guests must follow posted rules and staff instructions for safety reasons. The Restaurant is not liable for accidents or injuries resulting from failure to follow such instructions.
11. Third-Party Links and Services  
   Materials may contain links to third-party websites or services. We do not endorse and are not responsible for the content, privacy practices, or policies of those third parties.
12. Limitation of Liability and Indemnity

To the fullest extent permitted by law, the Restaurant and its owners, officers, employees, and agents shall not be liable for indirect, incidental, consequential, or punitive damages arising from use of the Materials or services, or from dining at the Restaurant. Guests agree to indemnify and hold harmless the Restaurant from claims, damages, or liabilities arising from their actions or omissions on the premises.
13. Governing Law and Venue  
   This disclaimer and any disputes relating to it are governed by the laws of the State of New York. Any legal action shall be brought in the state or federal courts located in Suffolk County, New York.
14. Changes to This Disclaimer  
   We may update this disclaimer at any time. Updated versions will be posted on our website and/or made available on request.

What to include in the T&C document

Generally speaking, T&C often address these types of issues: Who is allowed to use the website; the possible payment methods; a declaration that the website owner may change his or her offering in the future; the types of warranties the website owner gives his or her customers; a reference to issues of intellectual property or copyrights, where relevant; the website owner’s right to suspend or cancel a member’s account; and much much more.
